Q: Can I record that after my death, my house or property should be gifted to my wife?

A: A gift upon death is a bequest. A bequest is not valid for an heir. Hence, this is not permissible.

A person may gift items and assets as one wishes in one’s lifetime. The protocols of a valid gift must be fulfilled as follows:

1. Total Control
2. Possession of the asset must be completely transferred to the giftee
